Conditions of Use

 

1. Firearms and any other dangerous weapons, including but not limited to, any bowie knife, dirk, dagger, sling, shot, loaded cane, metallic knuckles, razor, stun gun or other deadly weapons are strictly prohibited from being on the premises.

2. The use of drones and/or other unmanned aircraft systems is prohibited.

3. Hazardous, flammable, or combustible liquids and/or materials are prohibited.

4. Fires and fireworks are prohibited.

5. Masks, hoods, or other devices whereby a substantial portion of the face is hidden or covered is prohibited, unless otherwise permitted by law and/or the covering is required by an individual’s religious practice.

6. Harassing and/or intimidating behavior is prohibited.

7. There shall be no behavior and/or activities to endanger the public welfare and/or safety of others.

8. No persons shall climb upon any tree, wall, fence, statue, fountain, building, or any other structure not specifically intended for climbing.

9. No pedestrian passage, sidewalk, entrance or exit shall be blocked or obstructed.

10. Requestors shall apply for a permit for any closure of public streets from the governing jurisdiction. Guilford County shall have no responsibility for liaising or coordinating with other entities or jurisdictions on behalf of the requestor and/or requesting organization.

11. No surface shall be penetrated while securing, assembling, or setting up tents, canopies, and/or other event equipment.

12. No alcoholic beverages or illicit/illegal substances shall be on the premises for the event, including during set-up and break-down.

13. Requestor will keep noise at a level so as not to disrupt governmental business, the business and operations of neighboring facilities, and/or nearby residential homes.

14. Vehicles of any kind shall only be permitted on paved roadways, parking spaces, or other areas specifically designed for vehicular parking by signage. No vehicle shall traverse sidewalks, walkways, plazas, or other areas not intended for vehicular travel.

15. Water tanks, vats, pools, and any other containers for water, except those for drinking water, shall be prohibited.

16. Handicap accessibility of facilities and properties shall not be impeded or blocked.

17. Trash, debris or other material shall be removed by the requesting organization at the conclusion of the event and at the end of the day if the event spans multiple days. Failure to do so may result in automatic declination of future events from the requesting organization.

18. Damages resulting from abuse or vandalism by participants shall be the responsibility of the requestor.

19. Requestor is required to be present for the event’s entire duration.

20. Loitering after the conclusion and event break-down is prohibited.

 

By signing below, the individual and organization requesting use of County facilities and/or property acknowledges and understands the following:

 

 Required insurance coverage, as determined by Guilford County’s Risk Manager, must be maintained throughout the duration of the requested use.

• Guilford County reserves the right, in its sole discretion, to require additional insurance coverage based on the proposed event activities. Failure to provide documentation of any additionally required coverage shall result in the request being declined.

• No County property will be available for use during the event, nor during set-up and/or break-down of the event.

• Requesting organization shall supply its own power source for the duration of the event and shall not rely on the County to provide power and/or connectivity to power sources.

• County staff will not aid with set-up, operation of the event, and/or break-down of the event in any official capacity of the County.

• Guilford County’s Facilities Use Guidelines shall govern the evaluation, as well as, the approval or declination of this request.

• Requesting organization accepts all responsibility for the actions if its staff, volunteers, contractors, invitees, and guests for the duration of the event.

• Guilford County reserves the right to require the requesting organization to contract, at sole cost to the organization, with off-duty law enforcement personnel for patrol during the event.

• Guilford County reserves the right to require the applicant to have County Security personnel present for the duration of the event, at the applicant’s sole expense, which shall be paid in full by certified check to the County by 5:00 pm EST three (3) business days prior to the date of use. A fee schedule is available upon request from the Guilford County Security Department. Failure to pay in full for Security’s presence shall mean the application for use is automatically declined.

Should the use of facilities not occur, the County shall refund the amount paid for Security personnel if the requestor provides a 24-hour advance written notice of the cancellation. Requestor shall forfeit any and all fees if a 24-hour advance written notice to the County is not provided.

• Guilford County has the sole discretion in approving and/or declining this application based on the Guilford County Facilities Use Guidelines.

Use of County facilities and/or property shall not violate any code, ordinance, regulation, or law of Guilford County, the State of North Carolina, the federal government, and/or any other applicable jurisdiction with regulatory authority.

• All Conditions of Use contained herein shall be adhered to in their entirety.

• Requestor and organization indemnifies and holds harmless the County, its agents, and its employees against any and all liabilities, claims, demands, actions, costs and expenses which may be sustained by reason of any injury to or death of any person, or for any loss or damage to property owned by person, caused by any negligent act or omission on the part of any member of my organization.

• The person signing below on behalf of the organization represents and warrants that s/he or it is signing with full authority to bind the party on whose behalf of whom s/he is signing to each and every acknowledgement and representation contained in this Application.
